Acceptable Usage Policy

The1host.com is a web hosting company that lives by its reputation of providing professional, courteous and responsible Internet services.  Therefore, we hold our clients to that same ethical standard.  As a web hosting company we have a responsibility to ensure that our clients are protected.  While the1host.com believes that all of our clients strive to adhere to the following policies guidelines, we are still obligated to remind each of our client's of their responsibility as an Internet user.  Any client of the1host.com that does not adhere to the following guidelines will forfeit the ability to continue hosting their website with the1host.com.

Rights of Others

It is unacceptable to post private information about others without their consent, defaming an individual or business, or infringing upon intellectual property rights of an individual or company.

The1host.com system and resources

The running of any programs in the background on our servers without prior notification including chat rooms, IRC bots, more than 1000 e-mails a day and any like process is unacceptable.  Any usage of 15% or more of our system resources is also unacceptable and will result in the termination of your account immediately and without prior written notice.  Additionally, any domain name that exceeds 8 gigabytes of traffic can be terminated.  We have the ability to correct these types of issues prior to the incident by allowing access for another domain name to be directed to your sites IP address for a one time $20.00 fee.  Usage of any scripts or utility to redirect domain names is not permitted either.  If you are getting close to your purchased system resource maximums, please contact us to avoid termination of your account because of system and resource abuse.  The1host.com maintains control and ownership of any and all IP numbers and addresses that may be assigned to the client and reserves in its sole discretion the right to change or remove any and all IP numbers and addresses.  The1host.com will create backups of your account daily on information that has changed and weekly for full backups.  No guarantees are made of any kind, either expressed, written or implied as to the integrity and success of these backups.  Backups are made for the1host.com system configurations only.  It is the sole responsibility of the client to maintain and create backups of their code, settings, and web content.  If a loss occurs due to an error by the1host.com we will make every attempt to recover any data up to the point of failure at no cost to the client.  However, if the loss occurred by an action of the client, the1host.com will attempt to recover the lost data from the most recent archive for a $50.00/hr recovery fee at the request of the client.

Client Responsibilities

The client is responsible for all activity arising and originating from their account.  The client is responsible for securing all data, passwords and logons for their account.  Client aggress to hold or have a way to obtain outside of the1host.com the knowledge needed to handle, execute, run and maintain a web presence.  The client agrees that the1host.com will not provide any web knowledge to the client without a prior written agreement or purchase of a specific package from the1host.com.

Unacceptable Usage and/or Content

Sending unsolicited advertising to those individuals or businesses that have no existing relationship or have no desire to receive such solicitation (spamming), Spamming from another source while promoting a web site hosted from the1host.com.(passive spamming), Inundating a recipient with e-mail with not intention of responding to such e-mails (email bombing), Using a return e-mail address or similar information to hide the actual return address of the sender from the recipient of the e-mail.(spoofing), the sending of unsolicited e-mails.  All pornographic content and sex-related merchandising is prohibited on all the1host.com servers. This includes sites that may infer sexual content or links to adult content elsewhere.  Also prohibited are sites that promote any illegal activity or present content that may be damaging to the1host.com servers or any other server on the Internet.  Links to such materials are also prohibited.  Examples of unacceptable content or links are pirated software, hacker programs or archives and warez sites.  The1host.com will be the sole arbiter in determining violations of this provision.  If you are unsure of your actions or feel that they may constitute a violation of the1host.com policies and guidelines, please contact us.

Unlawful Internet Activities

All services provided by the1host.com may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, distributing copyrighted material, gambling, schemes that defraud, harassment or threatening of another person, material we judge to be threatening or obscene or material protected by trade secret and other statute, drug dealing, attempting without authorization to access a computer system (hacking), attempts to circumvent any user authentication or security of a host, network or account, Probing the security of any network, spawning dozens of processes, port scans, ping floods, forging router information, denial of service attacks, the promotion or forwarding of any know or unknown virus, any activity which results in the loss of data, time in work, or money.  The1host.com reserves the right to check any and all system files, application files, email or any other data that resides on our servers for any perceived illegal material or for any reason so deemed appropriate by the1host.com or its attorney's.  The subscriber agrees to indemnify and hold harmless the1host.com from any claims resulting from the use of the service which, undermines the laws of the Internet or society in general.  The1host.com reserves the right to report illegal activities to any and all regulatory, administrative, and/or government authorities for possible prosecution.  We run and intend on continuing to run a clean, legal and respectable web service company.  The presence of any illegal program whether executed or not will result in a violation of this policy and the appropriate action will be taken

Limitation of Liability

The1host.com shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from the1host.com's servers going off-line or being unavailable for any reason whatsoever or the corruption or deletion of any web site from one of the1host.com's servers.  All damages shall be limited to the immediate termination of service.

The1host.com shall be the sole arbitrator of what is and is not a violation of these acceptable use policies.  The1host.com reserves the right to terminate an account at anytime and for any reason that causes harm to any of the1host.com clients web sites.  The1host.com reserves the right to delete all content and files from the account upon termination of said account.  Additionally, the1host.com reserves the right to withhold any pre-paid funds for any site removed for violations of these policies.  The1host.com reserves the right to refuse, cancel, or suspend service at our sole discretion.  The1host.com reserves the right to change the Acceptable Usage Policy without prior written notice or warning.  Non-enforcement of any part of the Acceptable Usage Policy does not constitute consent.  Violations of the Acceptable Usage Policy should be referred to us.

Summary

We reserve the right to refuse, cancel, or suspend service at our sole discretion.
All Sub-Networks, distributive hosting sites and dedicated servers of the1host.com must adhere to the above policies.  Failure to follow any term or condition will be grounds for immediate account deactivation.
